ARBITRATION CLAUSE

All disputes arising from this agreement will be settled between Belle Quaint and the petitioner. If no resolution is found within 60 days, then you agree that any dispute related to this agreement, will not be settled by a judge and jury but rather by a single arbitrator under the American Arbitration Association (AAA).

 

PURCHASES ON THIS SITE
Some areas of our Site may allow you to purchase products. These areas may be operated on our behalf by third parties, and additional terms and conditions may apply to your purchase of our product. Please also note that quantities of merchandise available for sale from this site are limited, so the merchandise may become sold out. If this shall occur, Belle Quaint will promptly refund any payment, which it may have received for merchandise that it is unable to deliver on a timely basis, or shall otherwise comply with the terms applicable to any purchase you make on our Site.

RATINGS & REVIEWS
These Terms & Conditions of Use ("Terms") govern your conduct associated with the Customer Ratings and Reviews service and related features (collectively, "RR Service(s)") offered by Belle Quaint LLC. To the extent of any conflict between these Terms and the Belle Quaint Privacy Policy, these Terms shall control only with respect to the RR Services.

By submitting any content to Belle Quaint, you represent and warrant that:

• You are the sole author and owner of the intellectual property rights thereto;
• You are not an employee or vendor of Belle Quaint
• All "moral rights" that you may have in such content have been voluntarily waived by you;

For any content that you submit, you grant Belle Quaint a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

 

All content that you submit may be used at Belle Quaint's sole discretion. Belle Quaint reserves the right to change, condense or delete any content on Belle Quaint website that Belle Quaint deems, in its sole discretion, to violate the Review Guidelines, any other provision of these Terms, Privacy Policy, or the Legal Notices published on BelleQuaint.com. Belle Quaint does not guarantee that you will have any recourse through Belle Quaint to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to seven business days. However, Belle Quaint reserves the right to remove or to refuse to post any submission for any reason, including without limitation, failure to comply with these Terms and/or the Review Guidelines. You acknowledge that you, not Belle Quaint, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of Belle Quaint, its agents, subsidiaries, affiliates, partners, or third-party service providers and their respective directors, officers, and employees.

 

By submitting your email address in connection with any RR Service, you agree that Belle Quaint and its third-party service providers may use your email address to contact you about the status of your review and other administrative purposes.

NO WAIVER

If Belle Quaint fails to act with respect to your breach or anyone else's breach on any occasion, Belle Quaint is not waiving its right to act with respect to future or similar breaches. If any provision of these terms of use shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.

 

HEADINGS
The headings in these Terms are for your convenience and reference. These headings do not limit or affect these Terms. These Terms, together with those items made a part of these terms by reference, make up the entire agreement between us relating to the Site, and replaces any prior understandings or agreements (whether oral or written) regarding the Site. If a court finds any of these terms to be unenforceable or invalid, that term will be enforced to the fullest extent permitted by applicable law and the other terms will remain valid and enforceable.
